On 24th January the Supreme Court issued a judgement, by a majority of 8 to 3 to the effect that an Act of Parliament is required to authorise ministers to give notice to the European Union of the UK’s decision to withdraw from it.

The decision was given on appeal by the Secretary of State for Exiting the European Union against a decision of the High Court in proceedings brought by Gina Miller and Deir Dos Santos to the effect that it was unconstitutional for ministers to give such notice in exercise of “prerogative powers”.

The decision has far reaching constitutional implications and is a reminder of the function of the judiciary within our democracy: to provide a check and balance on the powers of the executive.
