Why? If I die everything I own will go to my husband/wife, right?
But I thought it was just automatic if you were married?
No. If you die without leaving a will the Rules of Intestacy apply to all your property.
That sounds a bit complicated. What does it mean?
It means that your husband or wife will get all of your personal possessions and £250,000.00 of your property only.
Hang on a minute! My house is worth more than that. What happens to the rest?
Your husband or wife will get half of the rest and the other half will have to be held in trust for your children or remoter relatives.
That’s going to make things really difficult and awkward for my husband or wife if I die. What can I do about it?
Make a will and get some estate planning advice from a suitably qualified person, such as a solicitor.
I can’t do that, it’ll cost an arm and a leg!
